The lawsuit alleges that Perry engaged in a conspiracy to incite a violent insurrection on January 6, 2021. It was filed by a local Democratic activist and comes just weeks after Special Counsel Jack Smith obtained Perry's personal text messages in furtherance of his investigation into January 6, 2021.

The Colorado Supreme Court has already ruled that former President Donald Trump should be removed from the state's ballot, while other states like Michigan and Minnesota, have defined the confines of the 14th Amendment differently.
