Bayer pushes for liability shield amidst Roundup-related cancer lawsuits

Glyphosate: The cancer-linked chemical lurking in your produce
Glyphosate’s widespread use stems from its effectiveness as an herbicide, temporarily boosting crop yields in treated fields. However, it’s crucial to note that many herbicides lack the carcinogenic hazards associated with glyphosate. Additionally, organic farming, which avoids the use of Roundup and similar chemicals, has demonstrated scalability and cost reduction.

Unfortunately, the risk extends beyond field workers directly exposed to glyphosate. Residual glyphosate persists on most produce, with certain crops, like potatoes, posing significantly higher contamination risks by the time they reach consumers’ kitchens.

Bayer at ‘End of Rope’ in Roundup Cases, St. Louis Attorney Says

The U.S. Supreme Court on Tuesday rejected a bid by biotech giant Bayer to end thousands of lawsuits alleging its Roundup weedkiller causes cancer, likely costing the company billions of dollars in settlements.

The decision is another key defeat for Bayer. Together, the setbacks are expected to eliminate a legal standstill in unresolved cases, according to plaintiffs’ lawyers. Bayer now essentially has two choices, they say: Go to trial to fight more cases, or reach additional out-of-court settlements.

“Everything has kind of fallen apart on Bayer,” said Jim Onder, an attorney from the St. Louis-based Onder Law Firm. “They’re kind of at the end of the rope.”

Onder represents just under 20,000 plaintiffs in Roundup cases — about half of the unresolved caseload nationwide, he said.

Bayer said it “respectfully disagrees” with the court’s decision and that the company is “fully prepared to manage the litigation risk associated with potential future claims in the U.S.

Monsanto loses appeal in Supreme Court

Monsanto loses appeal in Supreme Court
Supreme Court won’t derail landmark Roundup cancer verdict - E&E News
The Supreme Court today said that it would not get involved in a long-running legal battle over cancer risk from exposure to a key ingredient in the popular Roundup weedkiller. In a short order this morning, the justices rejected Monsanto Co.s plea to overturn a ruling by the 9th U.S. Circuit Court of Appeals that allowed California resident Edwin Hardeman and others to pursue their claims that the company failed to warn users about the links between glyphosate and non-Hodgkins lymphoma (Greenwire, Dec. 9, 2019). Hardeman was awarded $25 million in a jury trial that is designed to serve as a test case for thousands of other similar challenges.

SCOTUS Denies Bayer's Roundup Appeal

Earlier today, the Supreme Court of the United States denied Bayer’s appeal regarding the safety of its weedkiller, Roundup. The decision marks an end to the years-long legal battle to determine if Roundup causes cancer, and the company will likely be forced to pay billions of dollars to settle current and future lawsuits.

Bayer acquired Roundup maker Monsanto back in 2018 for $63 billion. Since then, the company has been buried in lawsuits claiming that glyphosate – the primary ingredient in Roundup – causes cancer. Bayer has lost more than 50% of its market value since the acquisition and stocks dipped by about 4% on news of the Supreme Court’s decision.

For the better part of a decade, we’ve talked about the extreme danger that glyphosate poses to public health. This was before Bayer – known for manufacturing aspirin and birth control – acquired Monsanto, a leading herbicide manufacturer. Glyphosate has been shown time and again to cause cancer, but Bayer made one final attempt to have those claims dismissed in court.

In August of 2021, a California appeals court upheld an $86 million verdict that found Bayer responsible for a couple’s cancer after using Bayer’s glyphosate-based Roundup against weeds. The court was abundantly clear about Bayer’s guilt in the case:

Glyphosate Is a ‘Probable Human Carcinogen.’ Why Is It Still Being Used?

Glyphosate is now showing up in humans, but scientists are still debating its health effects. One thing is clear, though: Because it’s an effective and very cheap weedkiller, it has become pervasive.
