Η ευρωβουλεύτρια της Νέας Δημοκρατίας Άννα-Μισέλ Ασημακοπούλου έστειλε σε δεκάδες χιλιάδες απόδημους προεκλογικό υλικό και η ίδια ισχυρίζεται ότι τις διευθύνσεις τις απέκτησε με νόμιμο τρόπο τα τελευταία 5 χρόνια, ενώ χαρακτηρίζει θεωρίες συνωμοσίας ότι απέκτησε την λίστα με παράνομο τρόπο.

Όμως, οι καταγγελίες από τους ίδιους τους απόδημους που δεν είχαν ιδέα πως βρέθηκαν τα στοιχεία επικοινωνίας τους στην λίστα της κυρίας Ασημακοπούλου, αποδεικνύουν ότι πρόκειται για παρανομία. Η εγγραφή σε λίστα επικοινωνίας, εμπορική, ψυχαγωγική ή κομματική, είναι προσωπική υπόθεση. Δε μπορεί να γίνεται χωρίς τη συναίνεση του αποδέκτη της επικοινωνίας, οπότε οι δικαιολογίες της είναι γελοίες. Με τη μαζική αποστολή προεκλογικού υλικού εκ μέρους της δεν εξυπηρετείται η δημόσια υγεία, δε διευκολύνει αυτή η επεξεργασία δεδομένων την άσκηση οποιουδήποτε καθήκοντος της κυρίας Ασημακοπούλου ή δικαιώματος των πολιτών που ενέγραψε στις λίστες της χωρίς τη θέλησή τους, δε γίνεται αυτή η επικοινωνία για... ενημέρωσή τους για φορολογικές τους εκκρεμότητες ή... στα πλαίσια κάποιας σύμβασής τους με αυτή. Εν προκειμένω, η μοναδική αποδεκτή βάση είναι η συναίνεση του υποκειμένου των δεδομένων, η οποία πρέπει να παρέχεται ρητά, ελεύθερα και να μπορεί εύκολα να ανακληθεί.

Το Κόμμα Πειρατών Ελλάδας χαιρετίζει την εισαγγελική έρευνα για το πώς βρέθηκαν τα προσωπικά δεδομένα των αποδήμωνστα χέρια της κυρίας Ασημακοπούλου και των συνεργατών της. Σύμφωνα με τον Γενικό Κανονισμό Προστασίας Δεδομένων, η μη σύννομη επεξεργασία δεδομένων επισύρει σοβαρές κυρώσεις. Λόγω της φύσης της παραβίασης, θα πρέπει και η τιμωρία να είναι παραδειγματική, ώστε να μην ξαναμπεί κανείς στον «πειρασμό» να το επαναλάβει και να «πέσουν κεφάλια» στους εμπλεκόμενους, όπου και αν βρίσκονται. Η πολιτική ευθύνη εδώ είναι εξίσου σοβαρή με την ποινική.

Datatilsynets vedtak mot Meta utvides til EU/EØS og gjøres permanent

Fra Datatilsynet:

Meta har fått klar beskjed om at forretningsmodellen deres og bruken av personopplysninger strider med det europeiske personvernregelverket. De har sagt at de vil be brukerne om samtykke til å bruke dataene deres til adferdsbasert markedsføring i fremtiden. Selskapet har imidlertid ikke innført noen konkrete endringer ennå, og dermed fortsetter de ulovlige aktivitetene fortløpende.

Datatilsynet er dessuten i sterk tvil om Metas foreslåtte samtykkeløsning, som innebærer at de som ikke samtykker til adferdsbasert markedsføring må betale en avgift, vil være lovlig.

It is likely that most people will opt to provide consent rather than pay (and presumably this is what Meta are also expecting) but if that consent is not considered as freely given, Meta's advertising model will still be illegal.

This single step against Meta, could literally be the death blow to behavioural advertising in the EU and to be frank, it couldn't be more welcomed.

noyb win: First major fine (€ 1 million) for using Google Analytics

Swedish data protection authority (IMY) issued decisions against four companies and imposed a fine of 12 mio SEK (1 mio Euro) against Tele2 and 300.000 SEK against CDON for using Google Analytics on their webpage. Although many other European authorities (e.g. Austria, France and Italy) already found that the use of Google Analytics violates the GDPR, this is the first financial penalty imposed on companies for using Google Analytics, despite the CJEU's rulings on EU-US data transfers.

Finally there's some small steps to start to enforce these rulings. Hoping that this will set a precedent and inspire more DPAs to follow suit.

Hundreds of NHS hospitals have been ordered to share people’s confidential medical records with an American spy-tech company owned by a billionaire Trump donor, openDemocracy can reveal.

#Palantir Technologies – the secretive Silicon Valley firm first funded by the #CIA – will collect patient information from all hospitals in England, according to internal NHS documents.

On diffrent planets...

How obvious spyware is not recognized as such by people who should know better.

Sometimes it becomes apparent that people around me live on a completely different planet than myself. A couple of days ago the marketing people at my $DAYJOB posted a nice happy blog post about how to use one of our products to easily integrate Google Analytics (from now on "the spyware") on a website.

When I told them that this seemed inappropriate as the spyware has been (rightfully) found to violate the GDPR and illegal by a growing number of DPA's in the EU, they didn't even know about it. And even worse they clearly don't believe me.

I'm not sure if this is pure (willful?) ignorance, or that they probably use the vendor of the spyware to find information on the web and mainly get their news via commercial spyware (aka "social media") that has the same business model. I do begin to wonder though.

Thanks to @noybeu@mastodon.social for thorough documentation of the issue, and especially the links to the original decisions by the DPA's.

Microsoft 365 faces more GDPR headwinds as Germany bans it in schools: Redmond disputes report that ‘it is not possible to use without transferring personal data to the USA’

Germany’s federal and state data protection authorities (DSK) have raised concerns about the compatibility of Microsoft 365 with data protection laws in Germany and the wider European Union.

Under the GDPR, children below the age of 13 are incapable of consenting to their data being collected, while consent may be given by those with parental responsibility for those under 16 but not younger than 13. When platforms do store data on adults, those customers are meant to be able to request the deletion of their records.

Microsoft has denied that its assessment : “We ensure that our M365 products not only meet, but often exceed, the strict EU data protection laws. Our customers in Germany and throughout the EU can continue to use M365 products without hesitation and in a legally secure manner.”

That statement is not actually a categorical and clear denial of what Germany alleges. But actually my opinion is, if there is concern about any age group using this software for educational purposes, all the concepts (and use) can also be taught using open source LibreOffice and then there is no issue like this. Schools should anyway be teaching concepts and principles, that there are options out there, and to innovate around experimentation, adapting software, etc.

Cette décision fait suite à des décisions similaires des autorités néerlandaises et allemandes.
Pour être plus précis, il a été décidé que les écoles allemandes ne doivent pas utiliser les offres cloud telles qu’Office 365, G Suite et #iCloud en raison de violations de la vie privée. Le commissaire de Hesse à la #protection des #données et à la #liberté d’information a publié une déclaration selon laquelle, compte tenu du manque de transparence en matière de protection des données et de l’accès potentiel de tiers, aucune donnée personnelle d’écoliers allemands ne doit être stockée sur les serveurs de #Microsoft, Google ou #Apple en dehors de l’Allemagne.

Brace yourselves: New UK Data Laws are Coming

The Government have just announced their plans to gut the UK General Data Protection Regulation.

They are proposing to bonfire your rights and remove the protections the law affords to your:- Private life
- Vulnerabilities
- Aspirations.

This is but a natural product of poor proposals being discussed in a rigged consultation process.

Big multinational corporations, their lawyers, and corporate-funded think tanks were advising the Government on how to keep our data safe, courtesy of the “International Data Transfers Expert Council”.

At the same time, the Department for Digital, Culture, Media, and Sport were taking care of ignoring the critical voices of civil society and ordinary citizens, in a delicate balance of arbitrary cherry-picking and a smokescreen of wishful thinking.

The outcome of such a shiny example of integrity in policymaking is rather damning.

According to what the Government have announced, individuals would lose protections against discrimination and abuses, only to get less choices in return.

Dodgy businesses would get their licence to be malicious, reckless, and to launder your personal data overseas, far from your eyes and those of the Regulators.

The cherry on the cake, the Information Commissioner’s Office (the Regulator) would be coopted by the same Government they should keep an eye on.
