Leonard Leo's outsized role in shaping the Supreme Court and overturning Roe

Most Americans support abortion rights, but a dedicated minority of conservative activists has been working for decades to dismantle Roe v. Wade, and one man in particular has played an outsized role in that effort: Leonard Leo.

Leo leads the conservative legal organization the Federalist Society, through which he has spent the majority of his adult life getting conservatives appointed to the most powerful courts in this country, including the Supreme Court.

Regardless of whether #Abortion is legal, there will be women getting pregnant and not wanting to deal with the child. But whether the child's life ends before it develops consciousness or starving and freezing in a waste bin may depend on the legality of abortion.

It's interesting that Thomas didn't mention Loving v. Virginia in that same sentence. He's a black man who lives with his white wife in Virginia, the same state where Mildred and Richard Loving were arrested for being married to each other.

In #CedarRapids, #Iowa, yesterday, a male driver reportedly rammed his truck into a group of #women protesting the Supreme Court’s decision to overturn #Roe v. Wade. The collision sent at least one woman to the hospital. Local #police said that they’re investigating the incident.
Police said that an argument broke out between the driver of the truck and a protester before the collision, according to the Washington Post. Witnesses told the Huffington Post that the driver navigated around a line of cars, ran a red light, and plowed into the marchers, running over a woman’s ankle.
Video taken immediately after the incident shows women attempting to stop the truck, which continues to drive forward.

The 10th Amendment is an integral part of United States Constitutional law. There is no "right to abortion" in the US Constitution or Bill of Rights & as such, under the 10th Amendment, laws governing abortion are reserved to the states, or to the people.

(...) Although I eventually completed this novel and called it The Handmaid’s Tale, I stopped writing it several times, because I considered it too far-fetched. Silly me. Theocratic dictatorships do not lie only in the distant past: There are a number of them on the planet today. What is to prevent the United States from becoming one of them?

For instance: It is now the middle of 2022, and we have just been shown a leaked opinion of the Supreme Court of the United States that would overthrow settled law of 50 years on the grounds that abortion is not mentioned in the Constitution, and is not “deeply rooted” in our “history and tradition.” True enough. The Constitution has nothing to say about women’s reproductive health. But the original document does not mention women at all. (...)

Women were nonpersons in U.S. law for a lot longer than they have been persons. If we start overthrowing settled law using Justice Samuel Alito’s justifications, why not repeal votes for women?

Reproductive rights have been the focus of the recent fracas, but only one side of the coin has been visible: the right to abstain from giving birth. The other side of that coin is the power of the state to prevent you from reproducing. The Supreme Court’s 1927 Buck v. Bell decision held that the state may sterilize people without their consent. Although the decision was nullified by subsequent cases, and state laws that permitted large-scale sterilization have been repealed, Buck v. Bell is still on the books. (...)

Thus a “deeply rooted” tradition is that women’s reproductive organs do not belong to the women who possess them. They belong only to the state.

Wait, you say: It’s not about the organs; it’s about the babies. Which raises some questions. Is an acorn an oak tree? Is a hen’s egg a chicken? When does a fertilized human egg become a full human being or person? “Our” traditions—let’s say those of the ancient Greeks, the Romans, the early Christians—have vacillated on this subject. At “conception”? At “heartbeat”? At “quickening?” The hard line of today’s anti-abortion activists is at “conception,” which is now supposed to be the moment at which a cluster of cells becomes “ensouled.” But any such judgment depends on a religious belief—namely, the belief in souls. (...)

It ought to be simple: If you believe in “ensoulment” at conception, you should not get an abortion, because to do so is a sin within your religion. If you do not so believe, you should not—under the Constitution—be bound by the religious beliefs of others. But should the Alito opinion become the newly settled law, the United States looks to be well on the way to establishing a state religion. (...)

The Alito opinion purports to be based on America’s Constitution. But it relies on English jurisprudence from the 17th century, a time when a belief in witchcraft caused the death of many innocent people. (...)

Similarly, it will be very difficult to disprove a false accusation of abortion. The mere fact of a miscarriage, or a claim by a disgruntled former partner, will easily brand you a murderer. Revenge and spite charges will proliferate, as did arraignments for witchcraft 500 years ago.

If Justice Alito wants you to be governed by the laws of the 17th century, you should take a close look at that century. Is that when you want to live?

Here's where abortions are now banned or strictly limited, and where they may be soon

Abortion is now illegal or heavily restricted in at least 11 states following the Supreme Court's historic decision Friday to overturn Roe v. Wade. Twelve other states have laws in place that pave the way to quickly ban or severely restrict access to them, according to research from the Guttmacher Institute, a group that favors abortion rights. Several additional states appear likely to pass new laws.

Before Dobbs, state laws banning or severely restricting abortion access fell into three broad categories: 1) "trigger bans," which ban abortion under most circumstances and go into effect with the fall of Roe; 2) pre-Roe bans, which are old laws still on the books that could now be enforced; and 3) more recently passed laws that limit abortion to an early gestational age or ban it nearly totally. Some states had passed laws in more than one of these categories.

Thirteen states had trigger bans, laws that were written to take effect either immediately, by state official certification or after a 30-day waiting period, if Roe is overturned. Once they go into effect, these laws supersede other laws the state may have on the books, such as bans after a set number of weeks of pregnancy, said Elizabeth Nash, a state policy analyst with the Guttmacher Institute. ...

Supreme Court Overturns Roe v. Wade

The Supreme Court on Friday overruled Roe v. Wade, eliminating the constitutional right to abortion after almost 50 years in a decision that will transform American life, reshape the nation’s politics and lead to all but total bans on the procedure in about half of the states.

The ruling will test the legitimacy of the court and vindicate a decades-long Republican project of installing conservative justices prepared to reject the precedent, which had been repeatedly reaffirmed by earlier courts. It will also be one of the signal legacies of President Donald J. Trump, who vowed to name justices who would overrule Roe. All three of his appointees were in the majority in the 6-to-3 ruling.
