Big Brother will deine Daten

Auf gewerkschaftsforum.de machen sich Sophia Fielhauer und Christian Resei Gedanken, wie man für die KollegInnen die Datensammelwut von Microsoft einhegen und betriebsrätlich regeln kann. Sie kommen zu dem Schluss, dass dies inzwischen viel schwieriger geworden ist, als es noch zu Zeiten der "normalen" Office Pakete war.

Früher kaufte die Firma ein Softwarepaket und dafür musste mit dem Betriebsrat eine Vereinbarung über die Nutzung getroffen werden. In dieser wurde festgelegt, welche Aufgaben mit der Software zu erledigen waren und welche Daten eventuell von der Software über die MitarbeiterInnen erhoben und gespeichert und wie sie ausgewertet werden dürfen.
Seit Office 365 ist alles anders

Entwickelt aus Microsoft Office, beinhaltet Microsoft 365 außer Programm-Klassikern wie Word, Excel, Outlook oder PowerPoint nun unter anderem auch Teams, Planner, OneDrive und diverse Security-Apps rund um die Bezeichnung „Purview“ – kurz: eine unüberschaubare Anzahl an Apps. Rund 400 Millionen Abonnent:innen nutzen Microsoft 365 weltweit.

Durch das Online-Arbeiten entstehen ständig eine Reihe von Verhaltens- und Leistungsdaten. Damit jedoch auszuwerten, wer im letzten Monat den Laptop erst nach 9 Uhr aufgedreht hat, um die Pünktlichkeit oder die Arbeitsleistung zu kontrollieren, sollte ein No-Go sein. Jede Leistungs- und Verhaltenskontrolle muss jedoch in Betriebsvereinbarungen geregelt, bzw. verboten werden.

Die App Microsoft Forms beispielsweise hilft dabei, Online-Umfragen zu erstellen. Dazu schreiben die AutorInnen: „Es ist aber ein großer Unterschied, ob das Thema der nächste Betriebsausflug oder die Führungsqualität meines Chefs ist und ob die Umfrage sachlich oder wertend ist“, erklärt der Betriebsinformatiker Thomas Riesenecker von der Forschungs- und Beratungsstelle Arbeitswelt (FORBA).

Leicht gesagt - schwer durchzuführen

Ein erster Schritt für eine Betriebsvereinbarung wäre, festzuschreiben, welche Software für welchen Zweck eingesetzt wird. Doch Microsoft kann einfach die App ändern, Funktionen abschalten oder neue hinzufügen. Weder das Unternehmen noch die Arbeitnehmer:innen können diesen Vorgang beeinflussen: "Eine Besonderheit der Cloudtechnologie ist, dass viele nicht wissen, wie das Produkt nächste Woche aussieht", so Riesenecker.

Aber auch die Unternehmen sollten sich fragen, ob sie mit einem solchen Programm-Wirrwar leben können ...

Und dann noch KI

Auch Microsoft 365 Programme setzen seit geraumer Zeit auf künstliche Intelligenz. "Die Technologie von ChatGPT kommt nun in Microsoft 365 Copilot zum Einsatz. Durch die Verknüpfung mit diversen Apps von Microsoft 365 soll der Copilot dabei helfen, die Kreativität und Produktivität zu steigern und Aufgaben schneller und effizienter zu erledigen."

Wie sieht das dann praktisch aus? Ein sehr negatives Beispiel nennen die AutorInnen in dem Artikel: Wer beispielsweise das E-Mail-Programm Outlook von Microsoft 365 nutzt, mag sich fragen, woher die guten Antwortvorschläge auf E-Mails kommen – auch hier ist ein mitlernender Algorithmus, also eine KI, eingebaut. Und der ist nicht immer neutral. Die KI sorgte etwa dafür, dass Nutzer:innen, die nach dem Browser Google Chrome suchten, vor allem Antworten erhielten, in der die Vorzüge der Microsoft-Suchmaschine beworben wurden. Als Medien dies kritisch aufgriffen, reagierte Microsoft etwas kleinlaut: Es handle sich nur um ein Experiment, das man infolge des negativen Feedbacks auch schon wieder beendet habe.

Auch wenn das bereits ein erster hoher Gipfel von Manipulation war, es geht auch eine Nummer kleiner. Die Arbeitsleistung des einzelnen Beschäftigten kann durch "Hilfen" einer KI in beliebiger Richtung verbessert oder verschlechtert werden, ohne dass dieser einen Einfluss darauf hat. Noch eine Nummer kleiner aber auch gefährlich ist die bereits im Videokonferenztool Teams enthaltene Möglichkeit der Auswertung von Online-Meetings. Es gibt Protokolle unter anderem über die Dauer der Redebeiträge – damit lassen sich jederzeit die Beteiligten bewerten.

Für die beteiligten Betriebsräte kann die Regelung von Microsoft 365 leicht zu einer Daueraufgabe werden. Das sollten auch die Unternehmen bedenken, wenn sie darin nur ein günstiges und allumfassendes Angebot sehen.

Was gehört in eine Betriebsvereinbarung?

Speicherfristen,
Zweckbindung,
eine Folgenabschätzung
auch Schulungen für Arbeitnehmer:innen, die klarmachen, was im Hintergrund von Microsoft 365 passiert
welche Daten erhoben und gespeichert werden dürfen,
welche Datennutzung ausgeschlossen ist.

Hier stößt man leider weiter an die EU-Grenzen der DSGVO. Welche Daten in die USA übermittelt werden und wie diese genutzt werden, war bereits Gegenstand vieler Urteile des EuGH zu den inzwischen nichtigen Abkommen Safe Harbor, Privacy Shield, ...

Deshalb ist sich die Konferenz der unabhängigen Datenschutzaufsichtsbehörden Deutschlands einig, dass Microsoft 365 gegen die europäische Datenschutzgrundverordnung verstößt. Ein Beispiel: Offiziell entnimmt das Unternehmen nur Daten, um das sogenannte Nutzer:innen-Erlebnis zu optimieren. Dabei wird nicht immer um die gesetzlich vorgesehene Erlaubnis gefragt. Die erste Version des Rechtschreibprogramms von Word wurde beispielsweise in den USA einfach mitgetrackt, ohne dass Nutzer:innen dem zugestimmt hätten.

Unser Vorschlag: Jedes Unternehmen könnte viel Geld sparen und kostenlos das Open Source Paket Libre Office verwenden. Man würde sich damit sogar EU-konformer verhalten, weil es standardmäßig als Austauschformat .odt Dateien erzeugt und verwendet, wie sie in Europa genormt sind. Und einen datenschutzkonformes Videokonferenztool lässt sich bestimmt auch leicht finden, Jitsi oder BigBlueButton oder ...

Michelin – Clermont-Ferrand : la direction prise en flagrant délit

Vendredi 7 juillet, des salariés de l’atelier MMS de l’usine Michelin de la Combaude ont découvert qu’un prétendu détecteur de fumée cachait en réalité une caméra miniature.

Dans un premier temps, les responsables de l’usine ont nié leur responsabilité. Mais, devant le mécontentement des travailleurs, ils ont dû finalement reconnaître, dans chaque secteur, lundi 10 au matin, avoir fait poser cette caméra il y a plusieurs mois, prétendument « pour surveiller un distributeur de friandises ». Et d’argumenter qu’il n’y avait pas eu d’images enregistrées…

Ce scandale ayant été dénoncé dans les médias par la CGT, la direction de Michelin s’est sentie obligée de dire à la presse qu’elle s’excusait. Les responsables apparaissent ainsi pour ce qu’ils sont : de véritables flics et des pieds nickelés.

UK supermarket uses facial recognition tech to track shoppers

Attached to the ceiling above the gray shiny floor, watching as people enter the store, is a camera. The device scans faces, matching them against a corporate database of suspicious, potentially criminal shoppers who have been placed on a watchlist

The cameras are in breach of data rights and individual privacy

Every time a customer walks into a shop or business that uses Facewatch’s system, a biometric profile is created

Facewatch also adds to their watchlist subjects of interest posted on police websites

If staff have reasonable grounds to suspect a customer of committing a crime, whether it’s shoplifting or disorderly conduct, they can add the customer to a Facewatch list of “subjects of interest.” Facewatch’s policy notice says that the police also have the power to upload images and data to Facewatch’s system.

The #FBI used proprietary backchannels at Twitter to infringe on Americans’ #FirstAmendment rights and should be “ #abolished,” former #US Republican presidential candidate Ron Paul stated on Monday.

While Twitter has previously skirted accusations of violating Americans’ right to free speech by arguing it is a private corporation, Paul pointed out that recently released internal communications between employees of the social media giant and #government officials in the FBI and other agencies confirm the platform was acting as a surrogate of the state.

“Now we have proof that the FBI (along with US intelligence agencies and the Department of Homeland Security) have been acting through ‘private’ social media companies to manipulate what Americans are allowed to say when they #communicate with each other,” the former Texas congressman wrote in his weekly column for his website, the Ron Paul Institute for Peace and Prosperity.

“We do not need the FBI and #CIA and other federal agencies viewing us as the enemy and attacking our #Constitution. #End-the-Fed…and end the #Federal-Bureau-of-Investigation!” Paul concluded, referencing his long-standing call to liquidate the US’ privately-held central bank.

FBI agents emailed Twitter Trust and Safety chief #YoelRoth about 150 times between 2020 and 2022, according to internal communications released by platform CEO #ElonMusk earlier this month, with most messages involving requests for #censorship. However, even as Musk was releasing the Twitter documents, former FBI general counsel turned Twitter lawyer #JimBaker was ‘vetting’ the messages, allegedly without Musk’s knowledge. When this was brought to the billionaire’s attention, Baker was dismissed – but not before he had reshaped the narrative.

Twitter has reportedly hired dozens of FBI agents and other intelligence and military veterans in recent years, raising questions about the platform’s impartiality even before a lawsuit filed by the Missouri and Louisiana attorneys general revealed earlier this year that employees were regularly meeting with representatives of US government agencies to coordinate the #banning and #suppression of certain accounts and narratives.

While Paul questioned the media’s failure to make the #TwitterFiles the scandal that he felt they deserved, he was encouraged by a recent survey showing 70% of Americans believe Congress must take action to end #collusion between #BigTech and #BigBrother.

The FBI said in a statement released following the publication of the Twitter Files that the agency “regularly engages with private sector entities to provide information specific to identified foreign malign influence actors’ subversive, undeclared, covert or criminal activities.” It added that “private sector entities independently make decisions about what, if any, action they take on their platforms and for their customers after the FBI has notified them.”

Énormément d'organisations systématisent l'usage d'outils de "mercatiques" (marketing en anglais) informatiques dont les méls enrichis d'images et de liens trackeurs.

Ce n'est pas parce que cette pratique se banalise (assos, syndicats, commerces, banques, mutuelles,...) qu'elle est acceptable.

Je pense important que collectivement :

• nous fassions attention à ce que nos associations, syndicats, mutuelles,... ne rentrent pas dans ce genre de pratiques : n'espionnons pas nos destinataires !

• nous leur demandions d'arrêter ce genre de pratiques non respectueuses de la vie privée de leurs destinataires (et a priori) non respectueuses du RGPD puisque cela se fait "à l'insu de leur plein gré" !
  En effet, scrutez un peu les méls de beaucoup d'organismes aujourd'hui, ils sont truffés de liens et d'images qui vous pistent !

Damn. Looks like Google is going to enforce DMARC for email sent to Gmail now for even more sites than ever before.

DMARC is a combination of a dodgy message signing scheme (DKIM) combined with an entirely stupid and misguided way of trying to advertise the valid origins for a domain's email (SPF).

This may help cut down spam a wee bit, though I doubt it (most spam I still see is DKIM signed at least any may even be fully DMARC compliant)

However it's also going to bounce a lot of legitimate email in the near term.

Unfortunately they are not considering PGP-signed messages as "authenticated".
